About Attending an FtP Hearing

Being told your case will go to a Fitness to Practise hearing is daunting, and much of the anxiety comes from not knowing what to expect. This short course walks you through a hearing from start to finish so that the day feels familiar before it arrives.

You will learn who will be there and what each person does, how a hearing moves through its stages, what it is like to give evidence and be asked questions, and practical ways to prepare yourself, your documents and your support network.

It is also useful if you are supporting someone through a hearing, or attending a review hearing after an order has been made.

Only a minority of NMC cases reach a hearing. If yours does, a panel of the Fitness to Practise Committee decides the facts, then whether those facts amount to misconduct (or another ground) and whether your fitness to practise is currently impaired, and finally what sanction, if any, is needed to protect the public.

Hearings can be held in person or virtually, and are generally held in public, although matters such as health can be heard in private. Always check the details of your own hearing with the NMC and your representative. The hearing preparation checklist included with the course helps you get ready.

Attending an FtP Hearing: frequently asked questions

There are usually three. First, the panel decides which of the alleged facts are proved. Second, it decides whether those facts amount to misconduct or lack of competence (or another statutory ground), and whether your fitness to practise is currently impaired. Third, if it finds impairment, it decides what sanction is needed.
Generally, yes. Most Fitness to Practise hearings are held in public and the outcomes are published, but parts of a hearing that involve private matters such as your health can be heard in private. Check the arrangements for your own hearing with the NMC.
NMC hearings can take place in person, virtually or as a hybrid. The NMC will tell you how your hearing will be held, and you or your representative can raise any concerns about the format with them in advance.
A Fitness to Practise Committee panel usually has three members: a chair, a registrant member (a nurse, midwife or nursing associate) and a lay member. A legal assessor advises the panel on the law, and the NMC is represented by a case presenter.
You can be represented, for example by a union representative, solicitor or barrister, and you can usually bring someone for support. Speak to the NMC and your representative in advance about the arrangements for your hearing.
If the panel finds your fitness to practise is impaired, it can take no further action, or make a caution order, a conditions of practice order, a suspension order or a striking-off order. It should choose the least restrictive outcome that is enough to protect the public.
